European Parliament 2014-2019 Committee on Budgetary Control - The Secretariat - COORDINATORS' MEETING Monday, 10 September 2018 19.00-19.30 Brussels, Meeting room SDM S5 Summary of Recommendations Items for decision A. Programming of Committee missions in the first half of 2019 Coordinators were informed that committees were invited to submit their priorities for their travel activities in order to adopt the draft programmes for committee missions during the first half of 2019 (January-March) so that the draft programmes for committee missions can be adopted by the CCC at its meeting on 23 October 2018. According to the Bureau decision on Committee missions inside the EU, "No travel may be undertaken in an election year in the period from 1 April to 30 September". On committee ad hoc delegations outside the EU, on 15 March 2018, the Conference of Presidents has "decided, in view of the unprecedented workload for the remainder of the term, that... ad hoc delegations to third countries should not take place in the period from 1 January 2019 to 30 September 2019...". Please also be informed that: the missions should in principle be undertaken during the period set aside for external parliamentary activities; in this context, please note that the calendar for 2019 foresees for the respective PV\1163613.docx 7/16 PE627.953v01-00

period Thursday 28 February and Friday 1 March as days set aside for external activities. the requests must include all available information and details concerning the destination, dates (including travelling time), the number of Members taking part in a mission and justifications; it is recommended to already indicate the exact dates in order to facilitate the authorisation and to avoid the need to send additional letters; Decision: On the basis of all the above mentioned constraints and the workload of the committee until the end of the legislature, it was decided not to plan any CONT mission for the first half of 2019. B. Programming of committee Public Hearings in the first half 2019 Coordinators were informed that committees were invited to launch the programming exercise for committee public hearings during the 1 st half of 2019 (January-April), so that the draft programmes for committee Hearings can be adopted by the CCC at its meeting on 23 October 2018. For your information, the relevant Rules on Hearings relating to Public Hearings organised by committees foresee the following: - Each committee may hear a maximum of 16 guests each year whose expenses will be covered. Please note that the quota of 16 reimbursed quests is established on annual basis and should be shared between the outgoing and incoming committee; - The draft programme should be accompanied by appropriate information available (topic, justification, dates, number of guests, background); - Hearings shall take place on Parliament's premises during the ordinary meeting time of the organising committee. Coordinators were also informed that two public hearings are pending for the 2nd half of 2018: - Joint Public hearing with AGRI on LEADER experiences lessons learned and Effectiveness of EU funds for rural development (scheduled for 22 November in AGRI committee slot) - Public hearing on European Added Value (date TBC) One public hearing that was approved for the 2nd half of 2018 - Joint Public hearing with IMCO on Combatting customs fraud - was postponed to the 1st half of 2019 on the request of the rapporteur and after the approval of coordinators on 21 June 2018. Decision: The postponed public hearing with IMCO on Combatting customs fraud shall be sent for authorisation request for the first half of 2019. Based on the current workload of the committee it was decided not to request additional public hearings during the first half of 2019. C. Short Presentation of ECA Special Reports in CONT - review after one year of application (item postponed from 12 July) Coordinators received the statistics on the ECA reports presented in CONT and other committees between July 2017 and July 2018. In 2018, the ECA has published so far 16 Special Reports. 23 more Special Reports and 7 other "products" are announced to be published until the end of this year. Decision: Coordinators discussed the current procedure in place and decided - to discontinue the short presentation procedure, - to allocate 30 minutes to each presentation as default with a possibility to extend up to 45 minutes and - to select which Special Reports should be focussed on and which ones should not be presented in committee. Coordinators will be asked to take a decision on how to deal with the upcoming scheduled Special Reports by written procedure. The CONT Secretariat would advise to focus on Special Reports which deal effectively with an evaluation of how the EU budget is being spent. D. Discharge 2017- CONT Hearing with Commissioner Hahn - modification of date The dates of commissioner hearings in the framework of the discharge 2017 timetable were approved by coordinators during their meeting on 12 July 2018. However the cabinet of Commissioner Hahn requested on 26 July 2018 that the hearing scheduled for 10 October be moved to 18 October. Decision: Coordinators approved the proposed change of date for the hearing of Commissioner Hahn. The updated Discharge 2017 timetable can be found in Annex I. E. Workshop on The revision of OLAF regulation in light of the future cooperation with EPPO Coordinators received the draft programme of a workshop proposed to be organised by CONT Chair and rapporteur for the revision of the OLAF regulation report, Ms Gräßle. The workshop is scheduled to take place on 11 October 2018 in CONT committee time, the speakers are confirmed as shown in the draft programme. Appointment of the Commission Secretary General - findings of the Ombudsman On 4 September 2018 the European Ombudsman adopted her recommendation in joint cases 488/2018 and 514/2018 on the European Commission's appointment of a new Secretary- General. Mr De Jong, on behalf of the GUE Group has requested to add this issue on the agenda of the coordinators meeting and to have an exchange of views regarding the findings of the Ombudsman. Coordinators were informed that the meeting of the interinstitutional round table on the selection of senior management staff, convoked by Commissioner Oettinger will take place on 25 September at 15.00. In preparation of this round table, the CONT Chair prepared a questionnaire to be sent to all the institutions and advisory bodies in order to inquire about their modalities of appointing (Deputy) Secretary-Generals and (Deputy) Director-Generals. Draft programme - Joint CONT-AGRI hearing on LEADER experiences - Lessons learned and effectiveness of EU funds for rural development - 22 November 2018 Coordinators received for information the draft programme of the joint CONT-AGRI hearing on LEADER experiences - Lessons learned and effectiveness of EU funds for rural development which is scheduled to take place on 22 November 2018 in an AGRI committee slot. J. Establishment of EPPO CONT and LIBE Chairs are preparing a letter to Commissioners Jourová and Oettinger expressing some concerns related to the establishment of the EPPO, particularly in relation to human and equipment resources. Once finalised, the letter will be circulated to Coordinators for information. K. European Chief Prosecutor vacancy notice CONT coordinators received the vacancy notice for the European Chief Prosecutor as re-formulated by the Commission as well as the letter sent by the Commission to LIBE and CONT committees on this subject. According to Article 14 of the Regulation (EU) 2017/1939 of 12 October 2017 establishing the European Public Prosecutor s Office ( the EPPO ), the European Parliament and the Council shall appoint by common accord the European Chief Prosecutor for a non-renewable term of 7 years. The Commission prepared in July a draft Vacancy Notice for the post of the European Chief Prosecutor, and submitted it to the Council and the Parliament. Article 47 CEOS, which provides for the age of retirement at 66. In consequence the candidates should be no more than 59 years of age at the time of the appointment in order to complete the 7-year mandate. The Council disagreed with these provisions on age, and the Commission revised the Vacancy Notice so that it allows the fulfilment of the Chief s mandate until the age of 70. Such a change may require from the competent appointing authorities an exceptional prolongation of the retirement age, which would be considered as automatic if it becomes necessary to allow for the completion of the mandate. In the revised version, the Commission made also few drafting adjustments. Coordinators were informed that this new proposal has been accepted by the Council. L. Possible conflict of interests of the Prime Minister of the Czech Republic, Mr. Andrej Babiš Greens coordinator, Mr Staes raised a possible conflict of interests of the Prime Minister of the Czech Republic, Mr. Andrej Babiš. Coordinators decided to deal with this issue in the framework of the discharge, notably in the hearing with Commissioner Cretu. In addition, the Chair will invite Commission officials as soon as possible depending on the Commission s conclusion of its investigation, in order to explain at the basis of concrete examples how the Commission implements the new provision of the Financial Regulation concerning conflicts of interests in Member States. EXCHANGE OF VIEWS - OLAF INVESTIGATION CONCERNING A FORMER MEMBER OF THE EUROPEAN COURT OF AUDITORS (ECA) Exchange of views held in camera Rapporteur: Administrator: Ingeborg Grässle (EPP) Christian Ehlers The EU s anti-fraud office (OLAF) concluded an investigation into a former Member of the European Court of Auditors in June 2018. The initial allegations were submitted to OLAF by the European Court of Auditors. The OLAF investigation found an abuse of the European Court of Auditors assets, as well as infringements of ethical obligations. Upon conclusion of the investigation, OLAF addressed recommendations to the European Court of Auditors and to the judicial authorities of Luxembourg for possible follow-up. The Rapporteur proposes 85 amendments to the Commission proposal. His opinion in the form of amendments try to clarify parts of the legislative text and introduces several issues that were included in the EP resolution of 14 February 2017 on the role of whistle-blowers in the protection of EU's financial interests (2016/2055 INI). It also amends the proposal in order to ensure same kind of protection to EU staff members and eliminate restrictions to reporting.
